  1. In General

    Access to and use of this Website and the products and services available through this Website (collectively, the "Services") are subject to the following terms, conditions and notices (the "Terms of Service"). By using the Services, you are agreeing to all of the Terms of Service, which may be updated by us from time to time without notice. You should check this page regularly to take notice of any changes we may have made to the Terms of Service.

    Access to this Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason this Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all of this Website without notice.

  2. Privacy Policy

    These Terms of Service incorporate our privacy policy, which sets out how we will use your information, can be found at our privacy policy page. By using this website, you consent to the processing of information as described therein and warrant that all data provided by you is accurate.

  3. Prohibitions

    You must not misuse this website. You will not: commit or encourage a criminal offence; transmit or distribute a virus, trojan, worm, logic bomb or post any other material which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene; hack into any aspect of the Service; corrupt data; cause annoyance to other users; infringe upon the rights of any other person's proprietary rights; send any unsolicited advertising or promotional material, commonly referred to as "spam"; or attempt to affect the performance or functionality of any computer facilities of or accessed through this Website. We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this website or to your downloading of any material posted on it, or on any website linked to it.

  4. Intellectual Property, Software and Content

    The intellectual property rights in all software and content, including the Witchery brands and all other trade marks, trade names and logos made available to you on or through this website remain the property of Witchery Fashions Pty Ltd and its related bodies corporate (as defined in the Corporations Act 2001 (Cth)) (“Witchery”) or its licensors and are protected by copyright laws and treaties around the world. All such rights are reserved by Witchery and its licensors. You may store, print and display the content supplied solely for your own personal use. You are not permitted to publish, manipulate, duplicate, copy, sell, distribute or otherwise reproduce or exploit, in any format, any of the content or copies of the content supplied to you or which appears on this Website nor may you use any such content in connection with any business or commercial enterprise.

  5. Terms of Sale

    By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.

    Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or force majeure for which we will not be responsible. Please refer to our Delivery or Returns & Exchange pages for further information.

    In order to contract with Witchery you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. Witchery retains the right to refuse any request made by you.

    1. Our Contract
      1. When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. Unless otherwise provided for in these terms and conditions, you may not cancel or amend your order (including the delivery address, changes to colour or size, or removing items) after your order has been placed. Please ensure all details provided are full and correct at the time of order placement.  A contract between us for the purchase of the goods will not be formed until your payment has been approved by us and we have debited your credit or debit card.
    2. Pricing and Availability
      1. Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors (including processing errors) may occur. If we discover an error in the price or payment of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If the order is cancelled and you have already paid for the goods, you will receive a full refund.
      2. Where applicable, prices are inclusive of GST. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the 'Total Cost'.
      3. The Service may contain typographical errors or other errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to fill any orders that you may place based on information on the Service that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies.
    3. Payment
      1. Our website accepts payments using Visa, MasterCard, Amex, PayPal, AfterPay, Alipay and Apple Pay. We will place a pre-authorisation charge of $1 on your credit card  nominated form of payment for the first time it is entered on our website. Once your credit card payment method has been validated, upon clicking “PLACE ORDER” we will debit your credit card the funds immediately for the full order amount. Pre-authorisation charges will clear within 3 - 5 working days after placing your order (depending on your bank's or payment methods general practices). For stored payments in your WITCHERY account, no pre-authorisation charges will occur unless your stored payment is no longer valid.
    4. Discount Codes
      1. We may from time to time offer promotional discount codes which may apply in respect of any, or certain specified, purchases made though this Website.The conditions of use relating to any discount code will be specified at the time of issue.
    5. Gift Cards
      1. Gift Cards may be physical Gift Cards, or E-Gift Cards that are sent in an email. Gift Cards are issued in specific currencies, so that cards issued in New Zealand dollars are redeemable in New Zealand stores and on the New Zealand website, whilst cards issued in Australian dollars are redeemable in Australian stores and on the Australian website. They are not redeemable for cash or travellers cheques. No change will be given for a purchase made with a Gift Card. The Gift Card expires three years from the date of issue (or date of purchase for E-Gift Cards). Gift Cards are partially redeemable and it is up to the cardholder to use the full value within the validity period. Any unused balance will not be refunded or credited when the card expires. When the cost of a purchase exceeds the available card balance, the card holder will be required to make up the difference with an alternate form of payment. Your gift card is treated as a form of tender and cannot be used on Afterpay, Paypal, Alipay and Apple Pay orders. Gift Cards should be treated like cash. Gift cards cannot be redeemed on Witchery merchandise in David Jones stores or on David Jones’ website. Witchery disclaims all responsibility for lost or stolen cards. Gift Cards may not be purchased with Witchery Rewards, and their purchase will not earn (or count towards earning) Rewards.
  6. Disclaimer of Liability

    The material displayed on this Website is provided without any guarantees, conditions or warranties as to its accuracy. Unless expressly stated to the contrary to the fullest extent permitted by law Witchery and its suppliers, content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any damages whatsoever, including but without limitation any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this Website and any materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise. This does not affect Witchery's liability for death or personal injury arising from its negligence, nor for fraudulent misrepresentation, or any other liability which cannot be excluded or limited under applicable law.

  7. Linking to this Website

    You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

    You must not establish a link from any website that is not owned by you.

    This Website must not be framed on any other site, nor may you create a link to any part of this Website other than the home page. We reserve the right to withdraw linking permission without notice.

  8. Links from this Website

    If we link to other websites, we take no responsibility for the content of, and make no representations as to the accuracy of any third party websites we make link to from this Website.

  9. Indemnity

    You agree to indemnify, defend and hold harmless Witchery, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use of this Website or your breach of these Terms of Service.

  10. Variation

    Witchery shall have the right in its absolute discretion at any time and without notice to amend, remove or vary the Services and/or any page of this Website.

  11. Complaints

    We operate a complaints handling procedure which we will use to try to resolve disputes when they first arise: please let our customer service team know if you have any complaints or comments by emailing us at customerservice@witchery.com.au.

  12. Waiver

    If you breach these conditions, failure by us to take action will not constitute a waiver of our rights and remedies arising from that breach and we reserve our entitlement to enforce our rights and remedies in relation to that breach or any other situation where you commit a breach of these Terms of Service. Any waiver of any provision of the Terms of Service will be effective only if it is in writing and executed by Witchery.

  13. Governing Law and Jurisdiction

    These Terms of Service are to be construed in accordance with the laws of Victoria, Australia and in the event of any dispute or claim associated with these Terms of Service, that dispute or claim shall be subject to the exclusive jurisdiction of Victoria, Australia.

  14. Severability

    Any provision in these Terms of Service which is invalid or unenforceable in any jurisdiction is to be read down for the purpose of that jurisdiction, if possible, so as to be valid and enforceable, and otherwise must be severed to the extent of the invalidity or unenforceability, without affecting the remaining provisions of these Terms of Service or affecting the validity or enforceability of that provision in any other jurisdiction.

  15. Entire Agreement

    The above Terms of Service constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and Witchery.

Concept

1. Unwashed, unworn or unused items in their original condition may be returned upon presentation of a receipt within 14 days of purchase for an exchange, credit note or refund for the receipted price.

2. Faulty or incorrectly described merchandise may be returned for an exchange, credit note or refund upon presentation of your receipt within a reasonable time frame.

3. For hygiene reasons, there are no returns or exchanges on the purchase of cosmetics, earrings or underwear unless exhibiting a genuine fault or incorrectly described.

4. Bathers must be tried on wearing full briefs and returns will only be accepted in instances where the bathers are in original condition, unworn and the hygiene stickers and all tags are intact. All bathers will be assessed prior to any returns being processed.

5. Witchery offer lay-by terms requiring a non-refundable 25% deposit and full payment within 4 weeks of entering into the lay-by agreement with the exclusion of sale items. Sale items cannot be placed on lay-by.

6. Gift Vouchers are valid for 3 years from date of issue and cannot be redeemed at department stores. Gift Vouchers must be treated as cash and cannot be replaced if lost. Gift Vouchers may only be used in the country of issue within a Witchery store.

7. Exchanges and Returns of items purchased at a Witchery store must be returned to a Witchery store (not department store).

8. As a member of the loyalty program, Country Road Group collects your Personal Information. We may also collect your Personal Information to customise our services and plan product development together with notifying you of products and special offers that may interest you. Your Personal Information may be disclosed within our corporate group or to external providers based in Australia or overseas as per the Country Road Group’s Privacy Policy. Outlet

8. Seconds and samples product, which may be slightly faulty, must be chosen carefully as these items cannot be returned or exchanged due to the fault that was present at the time of purchase. If a seconds or sample product exhibits a fault not related to the fault known at the time of purchase, an exchange, refund may be offered as per point 2.

9. As a member of the loyalty program, Country Road Group collects your Personal Information. We may also collect your Personal Information to customise our services and plan product development together with notifying you of products and special offers that may interest you. WITCHERY GIFT CERTIFICATE CONDITIONS

  1. Certificate can be redeemed for merchandise only and not for cash.
  2. Lost, stolen or destroyed certificates will not be refunded in cash or replaced.
  3. Gift certificates are valid for 3 years from date of issue.
  4. Another certificate will be issued for under redemption.
  5. Gift certificates not be purchased online currently.
  6. Gift certificates cannot be redeemed in Witchery concession stores at David Jones or Clearance outlets.
  7. Gift certificates are in $AUD only and cannot be redeemed in New Zealand stores.
  8. Gift certificates cannot be used as payment online.
  9. Rewards can not be earned when purchasing gift vouchers

Witchery LOYALTY PROGRAM TERMS & CONDITIONS

DEFINITIONS

“Anniversary” means 12 months from (a) a Member’s Join Date or (b) the date that Member changed tiers, whichever date is the later.

“Effective Date” means 20 March 2018;

“Join Date” means the date a Member joins the Witchery Loyalty Program.

“Member” means individuals who sign up to the Witchery Loyalty Program.

“Member Emails” means emails that are sent from Witchery to a Member including emails about the individual’s membership, the Witchery Loyalty Program, special offers, discounts, competitions and events.

“Member Profile” means the personal details of the Member.

“Member Terms and Conditions" means these terms and conditions as amended from time to time.

“Witchery” means Witchery Fashions Pty Ltd ABN 13 067 573 291 its related entities and its authorised representatives.

“Witchery Loyalty Card” means the membership card issued by Witchery to a Member or where no card is issued, the Member login allocated to the Member.

“Witchery Loyalty Program” means the loyalty program operated by Witchery providing Members with access to Rewards in accordance with these Member Terms and Conditions.

“MOTO Order” means an online order placed on behalf of a Member by Witchery staff where a full priced item is not available in-store.

“Reach $1000 Reward’ means the Reward issued to a Member depending on their Member status at the date the Member achieves the Reach $1000 Spend Balance;

“Reach $1000 Spend Balance” means a Member’s net cumulative spend of $1000 on Valid Purchases in a Reach $1000 Spend Period.  A Members’ Reach $1000 Spend Balance is reset to $0 when a Reach $1000 Reward is issued or at the expiration of the Reach $1000 Spend Period provided that if a Member’s Reach $1000 Spend Balance exceeds $1000, any amount over $1000 will carry over to the next Reach $1000 Spend Period;  

Reach $1000 Spend Period a three (3) year period commencing on the later of:

  • the Effective Date; or
  • the date a Member is issued a Reach $1000 Reward; or
  • the date a Member makes their first Valid Purchase following the Join Date;

“Rewards” means rewards or other benefits given to Members as a consequence of purchasing behaviours, incentives and/or promotions.

“Spend Balance” means a Member’s net cumulative spend (i.e. after all discounts, returns etc have been applied) on Valid Purchases in the previous 12 months. For example, a Member’s Spend Balance as at the period 1 March 2018 will be their cumulative spend on Valid Purchases during the period from 1 March 2017 to 23:59:59 on 1 February 2018.

“Technical Issues” means the technical malfunction of any telephone network, connection or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the internet or at any web site or intranet site.

“Tier Spend Balance” means a Member’s net cumulative spend (i.e. after all discounts, returns etc have been applied) on Valid Purchases whilst they are a member of a tier.

“Valid Purchases” means all purchases except gift cards, delivery costs, tailoring services and selected merchandise which Witchery determines will not be eligible to earn Rewards.  Any purchases which are returned will not constitute Valid Purchases.

“Website” refers to the Witchery website witchery.com.au where details of the Witchery Loyalty Program (including the most up to date Terms and Conditions) can be found and where Members can monitor their Member status and Member Profile.

GENERAL

  1. The Member Terms and Conditions document the operation of the Witchery Loyalty Program, the use of the Witchery Loyalty Card, and any promotional activity and loyalty transactions that arise as a consequence of the Witchery Loyalty Program.
  2. Individuals who join the Witchery Loyalty Program agree to be bound by these Member Terms and Conditions.
  3. The Member Terms and Conditions may be modified at any time without prior notification by Witchery in its absolute discretion. Any modification to the Member Terms and Conditions may be applied to a Member retrospectively.
  4. Witchery will not accept any liability for any Member Email that is misdirected, lost or not received.
  5. Witchery will not accept any liability for any Technical Issues that may cause damage to any computer related to or used in connection with the Witchery Loyalty Program.
  6. Witchery may collect personal information from Members for the purpose of facilitating the Witchery Loyalty Program. Personal information will be handled in accordance with Witchery’s Privacy Policy- https://www.witchery.com.au/help/privacy-policy
  7. Witchery reserves the right to cancel, terminate, modify or suspend the Witchery Loyalty Program or any aspect of it or at its election, to payout any Rewards, reset Spend Balances, at any time and without notice. Without limitation to the foregoing rights, Witchery reserved the right to transfer Members to such other loyalty program owned, operated, managed or administered by Witchery, its ‘related bodies corporates’ or ‘associated entities’ as those terms are defined in Corporations Act 2001 (Cth).
  8. Witchery may, at any time and in its absolute discretion, require a Member to provide to Witchery proof of identification (in a form requested by Witchery) for Witchery to verify the authenticity of a Member’s membership and compliance with the Member Terms and Conditions. Failure to provide proof of identification may result in termination of a Member’s involvement in the Witchery Loyalty Program.  
  9. Witchery will not be liable for any tax liability incurred by a Member in connection with the Witchery Loyalty Program, including that incurred in the provision and/or utilisation of Rewards.
  10. These Member Terms and Conditions are to be read in conjunction with any additional conditions associated with Rewards, including without limitation with the Website Terms and Conditions and other relevant Witchery policies and or terms and conditions.
  11. Witchery’s decision in relation to all matters arising in relation to the Witchery Loyalty Program is final and binding.
  12. Reference to a ‘day’ in these Member Terns and Conditions shall mean a 24 hour period ending at 11.59pm AEDT;
  13. Any failure or delay by Witchery in exercising its rights under these terms does not constitute a waiver of those rights. Any waiver by Witchery must be in writing and signed by an authorised officer of Witchery.
  14. Nothing in these Member Terms & Conditions is intended to contravene any applicable law. To the extent that any provisions in these Member Terms and Conditions is invalid or unenforceable, it is to be read down so as to be valid and enforceable, and otherwise must be severed to the extent of any invalidity or unenforceability, without affecting the remaining provisions of these Member Terms & Conditions.

MEMBERSHIP

  1. Membership of the Witchery Loyalty Program is open to individuals who are 18 years or older with a unique email address.
  2. An individual becomes a Member as at the Join Date.
  3. An individual is deemed to be a Member when they sign up in store or online and or use their Witchery Loyalty Card during a transaction and/or earn or redeem Rewards.
  4. When joining in-store, a sales consultant will record the individual’s full name, email address and postcode at the register. Other details may be optionally recorded. An individual may update their Member Profile at any time by visiting the Website. It is the Member’s responsibility to update their Member Profile including their email, surname, birthday, phone and postal address.  If a Member has not provided or updated Witchery with correct details, Witchery may not be able to contact the Member about their membership, Rewards, special offers or entry to competitions.
  5. Applications may also be completed online by following the prompts in the checkout process.
  6. Upon joining the Witchery Loyalty Program, a Member will be allocated to a Witchery Loyalty Program tier on the basis of the transaction spend that qualified them to apply for membership. Details of the tiers are outlined below.
  7. Any Members who were Members prior to the Effective Date will be allocated to a Witchery Loyalty Program tier on the basis of the Member's Spend Balance for the period being twelve (12) months prior to the Effective Date and deemed to accept the Member Terms and Conditions on and from the Effective Date. Any Members with Silver Status prior to the Effective Date will be allocated to Silver Status on the Effective Date, except where their 12 month Spend Balance is greater than $2000, they will be allocated Gold tier status.
  8. At any time, Members may only have one account to the Witchery Loyalty Program and one corresponding Witchery Loyalty Card. Members may not transfer their account or Rewards to another person.
  9. Witchery reserves the right to modify, refuse or terminate a Member’s account to the Witchery Loyalty Program without notice or reason and at its absolute discretion.
  10. A Member may end their membership at any time by contacting Witchery’s Customer Service team on 1800 033 465 (AUS) or 0800 300 034 (NZ) and by email to customerservice@witchery.com.au.
  11. By joining the Witchery Loyalty Program, an individual consents to Witchery contacting them to provide them with consumer or marketing information and notifying them of Rewards or other products and special offers. 

WITCHERY LOYALTY CARD

  1. Once a Member has completed the application process in store, their Witchery Loyalty Card will be issued directly at point of sale. Members who complete their application on the Website are able to pick up a Witchery Loyalty Card when next in store upon presentation of identification displaying the Member’s name and address.
  2. Members may nevertheless record spend and otherwise utilise the benefits of the Witchery Loyalty Program without their Witchery Loyalty Card by: for purchases in store, providing an alternative form of identification displaying the Member’s name and address; or for purchases online, logging into their Witchery Loyalty Program account on the Website.
  3. The Witchery Loyalty Card remains the property of Witchery at all times.
  4. One Witchery Loyalty Card will be issued per Member on or after the Member’s Join Date.
  5. A current Witchery Loyalty Card, or alternative form of photo identification displaying name and address must be presented by the Member for all transactions in-store including (but not limited to) requests for discounts, recording of purchases, redeeming Rewards or in response to any promotional activity specific to the Witchery Loyalty Program.
  6. Only one Witchery Loyalty Card can be presented for each transaction.
  7. Members must notify Witchery immediately if their Witchery Loyalty Card is lost, stolen or misplaced. Witchery does not accept any responsibility or liability for any loss of a Member’s Witchery Loyalty Card or for any unauthorised redemption of Rewards.
  8. If an individual misplaces their Witchery Loyalty Card they can go in store and request a new card to be issued.
  9. If Witchery invites a Member to a special event they may be required to show their Witchery Loyalty Card or photo identification to gain entry or any applicable offers or discounts. 

EARNING WITCHERY REWARDS

  1. The Witchery Loyalty Program operates by attributing different Rewards (as nominated by Witchery from time to time) to the various tiers of the Witchery Loyalty Program.
  2. Members are allocated to tiers on the basis of their Spend Balance and Tier Spend Balance.
  3. When a Member completes a transaction and identifies themselves in-store by presenting their Witchery Loyalty Card or photo identification, the net amount of the Valid Purchase is added to their Spend Balance and Tier Spend Balance on the day after the transaction is made.
  4. When a Member completes a transaction online on the Website and identifies themselves by logging into their online Member account, the net amount of the Valid Purchase is added to their Spend Balance and Tier Spend Balance on the day after the order is dispatched, not at the time of order placement.
  5. Where a Valid Purchase is made in store, Rewards will be loaded onto the Member’s Witchery Loyalty Card approximately 48 hours after the Valid Purchase is made.
  6. Where a Valid Purchase is made online on the Website or by a MOTO Order, Rewards will be loaded onto the Member’s Witchery Loyalty Card approximately 48 hours after time of dispatch of first item in an online order and will expire depending on the Member’s tier status.
  • The currency in which Rewards are earned will be in AUD unless your country of residence in your Member Profile is NZ. For example, a Valid Purchase made in New Zealand will earn Rewards in NZD.
  1. Witchery will endeavour to notify the Member via email when the Member is entitled to a Reward or changes to a different tier in the Witchery Loyalty Program. If a member unsubscribes from Witchery Member Emails their Rewards balance will be viewable online only.
  2. At its sole discretion, Witchery may update a Member account with a Reward as a consequence of a purchasing behaviour, incentive and/or promotional activities.
  3. Witchery reserves the right to withdraw, cancel or vary the Rewards without notice and at any time for any reason whatsoever in its absolute discretion including without limitation Rewards awarded in error or Rewards earned fraudulently.
  4. Rewards cannot be sold, transferred or assigned and are not redeemable for cash or any other like instruments, including (but not limited to) gift vouchers, gift cards, cheques and credit notes. Rewards do not represent legal tender in any country. 
  5. Rewards cannot be earned using other Rewards as part of the transaction.
  6. If a Membership is terminated from the Witchery Loyalty Program, all outstanding and future Rewards will no longer be valid and will be rendered null and void.
  7. Only one transaction Reward will be earned and uploaded to a Member’s Witchery Loyalty Card per day.
  8. Rewards can be earned from Valid Purchases using layby or Afterpay purchase.
  9. When a Member returns a purchase in-store or via post, the net amount of the transaction will be deducted from the Member's Spend Balance and Tier Spend Balance and the Reward that was previously awarded will be adjusted or reversed.
  10. If an online order is cancelled, Witchery may adjust or reverse Rewards that were previously awarded to a Member in that transaction
  11. Members can view their Rewards at any time by logging into their account online on the Website.

TIERS & ASSOCIATED REWARDS

  1. Members are allocated to tiers on the basis of their Spend Balance (a Member's 'status') in the following manner and as depicted in the pyramid diagram below:
    1. Gold Member Status: members whose Spend Balance is $2500 or more;
    2. Silver Member Status: Members whose Spend Balance is $750 or more, but less than $2500;
    3. Bronze Member Status: Members whose Spend Balance is $300 or more, but less than $750;
    4. Member Status: Members whose Spend Balance is $300 or less.
  1. A Member may move at any time to a higher tier in the Witchery Loyalty Program when that Member’s Spend Balance qualifies them to move to the higher tier.
  2. On each Member’s Anniversary, a Member’s status will be determined by the Member’s Tier Spend Balance and the Member will, depending on the Member’s Tier Spend Balance, either retain their Member Status or be moved down to a different tier. The Member’s status will then remain in that tier until the next Anniversary unless the Member’s Spend Balance qualifies the Member to move to a higher tier.
  3. If at any time a Member’s status changes resulting in the Member changing tiers, the Member’s Tier Spend Balance reverts to zero dollars. A Member’s Tier Spend balance from the previous tier does not carry over to the Member’s new Tier Spend Balance.
  4. All Valid Purchases will contribute to a Member’s Spend Balance.

MEMBER STATUS

  1. Members with Member Status’are eligible to receive the following Rewards:
    1. All Member status Rewards which will expire 30 days after issue unless otherwise indicated;
    2. $10 Reward when they spend $100-$249: Members must spend between $100 and $249 in total in one day on a Valid Purchase after all Rewards have been redeemed and all discounts have been applied in order to receive the $10 Reward. Reward expires 30 days after date of issue;
    1. $35 Reward when they spend $250+: Members must spend $250 or more in one day on a Valid Purchase after all Rewards have been redeemed and all discounts have been applied in order to receive the $35 Reward which expires 30 days after date of issue;

REDEMPTION OF REWARDS

  1. Rewards can only been redeemed at Witchery stores in Australia and New Zealand and on the Website. Rewards cannot be redeemed in Witchery concessions stores in David Jones,  or Smith & Caughey and cannot be redeemed on David Jones Online.
  2. To redeem any applicable Reward when transacting online on the Website, a Member must ensure they are logged into a valid account.
  3. The currency in which Rewards are redeemed will be based on the location of the redeeming store. For example, a store based in New Zealand will redeem the Rewards in NZD. The Witchery Website and online store is based in Australia and consequently, will redeem Rewards in AUD.
  4. When redeeming any applicable Reward, the Reward will be applied proportionally across each item purchased, based on the percentage each item's represents of your total purchase. This will mean that the Reward will not be split equally across all items. 
  5. Rewards cannot be redeemed in conjunction with any other offer unless otherwise indicated.
  6. Rewards cannot be redeemed against purchases of the OCRF collection, or against purchases of gift vouchers, postage and tailoring.
  7. Rewards can be redeemed as payment for any part of a layby or Afterpay purchase.
  8. All Rewards have an expiry date as dictated by the Rewards in each tier at which point they will no longer be available for redemption. Witchery reserves the right to change the expiry date of any Reward at any time without notice.
  9. Only Rewards from one Witchery Loyalty Card can be redeemed per transaction.
  10. Witchery will not be held responsible or liable if Rewards are not able to be redeemed for whatever reason but specifically, in the case of a Technical Issue including without limitation the failure of software or hardware or an EFTPOS malfunction.
  11. Rewards can only be redeemed once.
  12. Witchery reserves the right in its absolute discretion to exclude certain items and promotions from being redeemed by using Rewards.
  13. Returns: If a customer wishes to return a purchase for reasons other than that the goods are faulty or misdescribed:
    1. any Reward redeemed or utilised during the purchase will be forfeited; and
    2. any Reward that may otherwise have been obtained (such as through being promoted to a higher tier) will be kept but the Member will have the value of the return transaction deducted from their Spend Balance. This may result in the Member having a negative Spend Balance or Tier Balance

Direct To Your Door Transactions & Issuing of Rewards

Direct to Your Door purchases are available on full price merchandise only, in Australian & New Zealand stand alone stores. Excludes already reduced merchandise, Witchery South Africa and Witchery concession stores. Your Direct to Your Door transactions may affect the way your Rewards are issued. Direct to Your Door orders are treated as a unique order, separate from any items you may have purchased in-store. As you are only eligible for one Reward per day, the Direct to Your Door transaction may not trigger the issue of any Rewards.
